Real Life Potions Affiliate Program Terms and Agreement

1. Program Participation

1.1 Eligibility

• Are at least 18 years of age.
• Have a valid tax ID or Social Security Number.
• Have provided accurate personal and business information.
• Have the authority to enter into this agreement.
• Will represent the Real Life Potions brand with integrity.

1.2 Account Responsibility

• Maintain the security of their login credentials.
• Update account information as needed.
• Use only one affiliate account per person or entity.
• Notify Real Life Potions immediately of any unauthorized access.
• Uphold the brand’s mission and values.

2. Commission Structure and Payments

2.1 Commission Terms

• Base Commission Rate: 10% on qualified product sales.
• Growth-Based Tiers: Affiliates advance through higher commission levels based on their referral count:
  • Base Level: 10% commission (0-25 referrals).
  • Silver Level: 12% commission (26-50 referrals).
  • Gold Level: 15% commission (51-100 referrals).
  • Diamond Level: 18% commission (100+ referrals).
• Cookie Duration: 365 days, allowing earnings on purchases up to a year after the first click.
• Minimum Payout Threshold: $25.
• Payment Schedule: Monthly payments processed by the 15th.
• Bonus Commissions: Available for select product launches or events.

2.2 Commission Calculations

• Customer Purchase: $100 product + $8 tax + $12 shipping = $120 total.
• Commission: $100 × 10% = $10.

2.3 Cookie Duration Benefits

• Earn commissions on all customer purchases for 365 days after the first click.
• Multiple purchases from the same customer within this period qualify for commission.
• Cookie duration resets with each new click on your affiliate link.
• Last-click attribution applies if multiple affiliate links are clicked.

2.4 Payment Conditions

• Commissions paid only on completed, non-refunded sales.
• Deductions may apply for returns or order cancellations.
• Payment Methods: PayPal, Cash App, or store credit (with an additional 5% bonus for store credit).

3. Marketing Guidelines

3.1 Permitted Marketing Methods

• Use only approved marketing materials provided by Real Life Potions.
• Keep product descriptions accurate and up-to-date.
• Follow all provided brand guidelines.
• Share authentic product experiences aligned with the brand’s self-care mission.

3.2 Prohibited Activities

• Send unsolicited or spam emails.
• Bid on “Real Life Potions” or “RLPotions” trademark terms.
• Make misleading claims about product benefits.
• Engage in deceptive marketing practices.
• Promote on adult, illegal, or unapproved websites.
• Use tactics such as cookie stuffing or link manipulation.
• Make unapproved medical claims about products.

4. Legal Compliance

4.1 FTC Disclosure Requirements

• Disclose their affiliate relationship with Real Life Potions clearly.
• Use the provided FTC-compliant disclosure language.
• Ensure disclosures are prominently placed and updated as required by law.

4.2 Intellectual Property

• Respect Real Life Potions’ trademarks and copyrights.
• Only use marketing materials as authorized.
• Avoid altering logos or brand materials.
• Not register similar or competitive domain names.

5. Privacy and Data Protection

5.1 Data Handling

• Protect customer data and confidentiality.
• Refrain from sharing, selling, or misusing customer information.
• Comply with applicable privacy laws, including GDPR if relevant.
• Report any data breaches immediately to Real Life Potions.

6. Product Representation

6.1 Product Claims

• Use only approved product descriptions and claims.
• Avoid making unapproved medical or cure claims.
• Share genuine product experiences.
• Comply with FDA and FTC guidelines for beauty and wellness products.

6.2 Brand Values

• Uphold Real Life Potions' commitment to quality and wellness.
• Represent the brand’s support of the Black community and responsible self-care practices.
• Align promotional efforts with the brand’s values.

7. Term and Termination

7.1 Agreement Duration

• Agreement becomes effective upon registration.
• Either party may terminate the agreement with written notice.
• Real Life Potions may terminate immediately for any violations.

7.2 Post-Termination

• Remove all Real Life Potions materials from online and offline channels.
• Complete any pending transactions.
• Receive a final commission payment, if eligible.
• Return any confidential information.
• Cease using Real Life Potions brand name and materials.

8. Support and Communication

• Dedicated affiliate support at lavonia@rlpotions.com.
• Regular program updates and performance tracking.
• Professional marketing materials.
• Product education, including early access to new product information.
• Monthly strategy calls for Diamond-level affiliates.

9. Special Promotions and Events

• Advance notice of upcoming sales and promotions.
• Affiliate-only discounts.
• Early access to new products.
• Exclusive training events and opportunities for increased commissions.

10. Tax Responsibility

• Responsibility for all taxes related to earnings.
• Independent contractor status.
• Requirement to submit necessary tax documentation (e.g., 1099 forms).
• No entitlement to employee benefits or rights.

• Confirm that you have read and understood this agreement.
• Accept all terms and conditions.
• Confirm your eligibility to participate.
• Agree to adhere to program requirements.
