Welcome to TOFOU Music Affiliate Program! These Terms & Conditions ("Agreement") govern your participation in the Affiliate Program ("Program"). By applying to become an Affiliate, you agree to comply with the terms and conditions set forth herein. Please read them carefully.

1. Enrollment in the Affiliate Program

To begin the enrollment process, you must submit a complete application through our affiliate sign-up page. We reserve the right to approve or reject any application at our sole discretion. Affiliates must be at least 18 years old to participate.

2. Affiliate Links and Tracking

As an approved Affiliate, you will be provided with unique tracking links ("Affiliate Links"). You are responsible for using these links correctly to track your referrals. All sales referred via your affiliate link will be tracked by our system, and you will earn commissions based on those sales.

3. Commission Structure

Commissions will be earned based on the sales made by customers referred through your affiliate link. The percentage or amount of commission will be specified in your affiliate dashboard and may vary depending on the product or service being sold. We reserve the right to change the commission structure at any time with prior notice.

4. Payment Terms

Commissions will be paid monthly or as specified in your affiliate dashboard. Payments will be made via PayPal, provided you meet the minimum payout threshold, as outlined in your account. You are responsible for any taxes or fees incurred from your earnings.

5. Refunds and Chargebacks

If a customer who clicked your affiliate link requests a refund or if there is a chargeback on their payment, the corresponding commission will be deducted from your account. Commissions are based on completed sales, and refunds/chargebacks may reduce your earnings.

6. Restrictions on Promotional Methods

Affiliates are prohibited from using any deceptive, misleading, or unethical promotional methods. These include but are not limited to:

Bidding on brand terms in paid search advertising (PPC).
Sending unsolicited emails or engaging in spamming.
Impersonating the company or misrepresenting your relationship with the company.

7. Intellectual Property

You are granted a non-exclusive, non-transferable license to use our brand name, logos, and trademarks solely for the purpose of promoting our products in accordance with these Terms. You may not use our intellectual property in any manner that could harm our reputation or brand.

8. Termination of the Affiliate Relationship

Either party may terminate this Agreement at any time by providing written notice. Upon termination, you must immediately cease using all affiliate links, promotional materials, and any intellectual property associated with our brand. Any unpaid commissions owed to you will be paid according to our usual payment schedule, provided they meet the payout threshold.

9. Privacy and Data Protection

As an Affiliate, you may receive access to certain customer information. You agree to use such data exclusively for the purposes of this Program and in compliance with all applicable privacy laws, including data protection regulations. You must not share or misuse any personal data.

10. No Warranty and Limitation of Liability

We do not make any representations or warranties regarding the success or profitability of your participation in the Affiliate Program. Our liability is limited to the total commissions due to you under this Agreement. We are not responsible for any indirect, incidental, or consequential damages that arise from your participation in the Program.

11. Modifications

We reserve the right to modify, update, or change the terms of this Agreement at any time. You will be notified of any significant changes. Continued participation in the Program after such modifications will be deemed as acceptance of the updated terms.

12. Entire Agreement

This Agreement constitutes the entire understanding between the parties with respect to the Affiliate Program. If any provision is found to be invalid or unenforceable, the remainder of the Agreement will continue in full force and effect.

By submitting your application to participate in the Program, you acknowledge and agree to these terms and conditions. If you do not agree with any part of this Agreement, you should refrain from joining the Affiliate Program.

5. How do I get paid?

We process affiliate payments on a monthly basis via PayPal. There is a minimum payout threshold of $30 USD dollars to receive a payment.

6. Where can I promote my affiliate link? 

You can share your affiliate link on your website, blog, social media, email newsletters, or other marketing channels, as long as they comply with our affiliate terms and conditions.

7. Can I use paid advertising to promote my affiliate link? 

Yes, but certain restrictions apply. Affiliates are not allowed to bid on our brand name or use misleading advertising. Please refer to our affiliate terms for full details.

8. How do I track my referrals and earnings? 

Your affiliate dashboard provides real-time tracking of clicks, conversions, and commissions. You can monitor your performance anytime.

9. What happens if a referred customer requests a refund?

If a customer you referred requests a refund, the commission earned on that sale will be deducted from your balance.
